Preamble
Scope & acceptance
These General Terms and Conditions of Sale ("T&Cs") govern all sales of products offered on the website www.climax-store.com (the "Website"), operated by Wellness First, a company registered under French law, trading under the brand name Climax.
These T&Cs apply exclusively to end consumers acting for personal, non-commercial purposes ("Customer(s)"). They do not apply to resellers, distributors, affiliates, ambassadors, or any other professionals purchasing for the purpose of resale or commercial use. Any person or entity wishing to purchase Products for professional or resale purposes must contact the Company directly at info@climax-store.com to enter into a specific commercial agreement. The Company reserves the right to refuse or cancel any order placed on this Website by a professional buyer not covered by a specific written agreement.
Any order placed on the Website constitutes full and unconditional acceptance of these T&Cs. The Company reserves the right to update these T&Cs at any time; the version in force at the date of the order applies.

Article 2
Products
2.1. Product Descriptions
The Company offers for sale a range of adult wellness and pleasure products under the brand Climax, including vibrators, couples' accessories, pelvic floor trainers, cock rings, anal plugs, and related accessories. Product descriptions, technical specifications, and photographs are provided for information purposes. Minor variations between on-screen representation and delivered products shall not give rise to any claim.
2.2. Age Restriction
All products sold on this website are intended exclusively for adults aged 18 years or over. By placing an order, the Customer expressly confirms they are aged 18 or over and that the laws of their country of residence do not prohibit the purchase, possession, or use of such products. The Company reserves the right to request proof of age and to cancel any order placed by or on behalf of a minor.
2.3. Availability
Products are offered subject to availability. If a Product becomes unavailable after an order is placed, the Company will offer either a restocked delivery date, a substitute Product of equivalent quality and price, or a full refund.
Article 3
Prices
All prices are expressed in euros (EUR) inclusive of all applicable taxes (VAT included). For Customers resident in France, French VAT at the standard rate of 20% applies. For Customers resident in other EU Member States, VAT is collected and remitted by the Company in accordance with the EU One Stop Shop (OSS) scheme, at the rate in force in the Customer's country of residence at the time of the order.
The Website does not deliver outside the European Union. Delivery charges are indicated separately at checkout before order confirmation.
Article 4
Placing an Order
4.1. Order Process
- Select the desired Product(s) and add them to the shopping cart
- Review the cart and proceed to checkout
- Provide delivery and billing information
- Select a delivery method and payment method
- Review the order summary and confirm acceptance of these T&Cs
- Confirm the order by clicking the payment button
The Customer is responsible for the accuracy of all information provided. The sale is definitively concluded upon dispatch and sending of a shipping confirmation email.
4.2. Order Confirmation
An automated order confirmation email is sent upon payment. This constitutes acknowledgment of receipt but not final acceptance. The Company reserves the right to cancel any order in the event of a manifest pricing error, payment failure, fraud suspicion, product unavailability, or an unresolvable delivery address error.
4.3. Modification & Cancellation
Orders may be modified or cancelled prior to dispatch by contacting orders@climax-store.com. Once dispatched, the Customer must exercise their right of withdrawal in accordance with Article 8.
Article 5
Payment
Accepted payment methods include credit and debit cards (Visa, Mastercard, American Express), PayPal, and any other method listed at checkout. All transactions are processed through secure, encrypted protocols. The Company does not retain bank card details on its servers. Payment is due in full at the time the order is placed.
Article 6
Delivery
6.1. Delivery Areas
The Company delivers to France (Metropolitan France and overseas territories) and to European Union Member States. Delivery is not available outside the European Union.
6.2. Timeframes
Delivery methods, carriers, and indicative timeframes are presented at checkout. Timeframes are estimates and are not contractually binding. In the event of a delay exceeding 30 days from the estimated delivery date without explanation, the Customer may request cancellation and a full refund.
6.3. Discreet Packaging
All Products are shipped in plain, unmarked outer packaging bearing no reference to the contents or to the Climax brand. Only the sender's address and any legally required customs declarations are affixed to the outer packaging.
6.4. Transfer of Risk
Risk of loss and damage passes to the Customer upon physical delivery. In the event of a failed delivery due to an absent recipient, the Company shall not be liable for loss of a parcel arising from the Customer's failure to collect it within the carrier's specified timeframe.
Article 7
Transfer of Title
Title to the Products passes to the Customer upon full receipt of payment in cleared funds, regardless of the date of delivery. Until such time, the Company retains title and may request their return.
Article 8
Right of Withdrawal
8.1. General Right
In accordance with Articles L. 221-18 et seq. of the French Consumer Code and Directive 2011/83/EU, EU-resident Customers have the right to withdraw from any distance purchase contract within fourteen (14) calendar days of taking physical possession of the Products, without giving reasons and without penalty.
8.2. Hygiene Exception
Pursuant to Article L. 221-28, 5° of the French Consumer Code, the right of withdrawal does not apply to Products that have been unsealed after delivery and that cannot be returned for hygiene or health protection reasons. The right of withdrawal therefore applies only to Products returned in their original, sealed, unopened packaging with all accessories and documentation included.
8.3. How to Exercise
To exercise the right of withdrawal, the Customer must notify the Company by unequivocal written statement before the expiry of the withdrawal period, by email to info@climax-store.com or via the withdrawal form available on the Website. Products must be returned within 14 calendar days of the withdrawal notice. Direct return shipping costs are borne by the Customer unless otherwise specified.
8.4. Refunds
Upon receipt and inspection of returned Products, and provided the conditions of Article 8.2 are satisfied, the Company will reimburse all payments received — including standard delivery charges — within 14 calendar days, using the same payment method as the original transaction.
Article 9
Legal Warranties
(i) Warranty of conformity — pursuant to Articles L. 217-4 et seq. of the French Consumer Code, the Company is liable for any lack of conformity existing at the time of delivery and manifesting within two (2) years thereof. During the first 12 months, the Customer is not required to prove the existence of the defect.
(ii) Warranty against hidden defects — pursuant to Articles 1641 et seq. of the French Civil Code, the Company is liable for hidden defects rendering the Products unfit for their intended use. To invoke either warranty, contact info@climax-store.com with proof of purchase and a description of the defect.
Article 10
Contractual Warranty
Each electronic Climax Product is covered by a one (1) year limited contractual warranty against manufacturing defects from the date of purchase. This warranty does not cover misuse, accidental damage, normal wear and tear, unauthorised modification, or immersion beyond the product's rated water resistance. In the event of battery failure during the warranty period, the Company will provide a replacement unit. Sealed batteries are not user-replaceable; opening the product voids this warranty. Non-electronic products (Pure rings, Roll dice, accessories) are not covered by this contractual warranty but remain subject to applicable legal warranties.
Article 11
Liability
The Company's liability is limited to the amount paid by the Customer for the Products in question. The Company shall not be liable for indirect, consequential, or special damages, nor for any failure or delay arising from causes beyond its reasonable control. Nothing in these T&Cs limits the Company's liability for death or personal injury caused by its negligence, or for any other liability that cannot be excluded by law.
Article 12
Personal Data
The Company collects and processes personal data in accordance with its Privacy Policy, available on the Website. Personal data is processed for order management, delivery, customer service, and — where explicit consent has been given — marketing communications. The Company does not sell personal data to third parties. Customers may exercise their GDPR rights (access, rectification, erasure, portability, objection) by emailing info@climax-store.com.
Article 13
Intellectual Property
All content on the Website — including texts, product descriptions, photographs, illustrations, logos, and layout — is the exclusive property of the Company or its licensors and is protected by applicable intellectual property laws. Any reproduction, distribution, or modification without prior written authorisation is strictly prohibited.
Article 14
Governing Law & Jurisdiction
These T&Cs are governed by French law. In the event of a dispute, the Customer is encouraged to contact info@climax-store.com for amicable resolution. In the absence of resolution within 60 days, the Customer may refer the matter to a qualified consumer mediator or use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Failing mediation, disputes are subject to the exclusive jurisdiction of the competent French courts, save for mandatory provisions granting jurisdiction to courts in the Customer's EU country of residence.
Article 15
Miscellaneous
If any provision of these T&Cs is held invalid or unenforceable, the remaining provisions shall continue in full force. The failure to enforce any right shall not constitute a waiver thereof. These T&Cs, together with the order confirmation and Privacy Policy, constitute the entire agreement between the Company and the Customer.
